Who's "we"?

Oh and there's the little detail of that executive order of the Federation President signed after the Hobus event stating the Federation still abides by this treaty despite the Romulans being regarded by the Federation as a new people.

We the Federation.

*Shrug* well treaties orders or not, cloaks are commonplace now (compared to pre-Hobus).

It wouldn't be the first time Starfleet sidestepped the government.

Also, spoiler alert: there is no Romulan government. It's collapsed. There have been factions engaged in civil war in the anarchic remains of the Romulan Empire but of the two most prominent leaders, one got assimilated and the other one got kidnapped.

There's no one for us to have a cloak treaty with.
