They were certainly considered canon by the fanbase, but that's the problem...unless it was on the screen or made by the prducers of the shows, it's not canon.
Same goes for fans of SFB, who consider it canon for the same reason fans of the old FASA stuff consider it canon: it's more consistent.
Even though the Orion Wanderer made a cameo on a computer screen in TNG, that's about as useful as the appearance of the Millenium Falcon in "First Contact".
Stuff made by FASA still belongs to FASA...or whoever took over FASA.
Means no chances for me to get a Riskadh.
Sadly I've developed my love of Klingon starships from non-canon sources (SFB,SFC, klingon academy, etc) and have no love for the canon ships. Until STO breaks away from on-screen canon we'll only get the same old crap we have now. No SuvwI'QeH, no voDleH class, no pumwI'-class. Instead we'll get BoP's that dwarfs D7's in size, more Negh'Vars and vorcha's.
The D5 would be nice, as well as an upgrade to the Koro'T'inga.

Not anymore. Microsoft lost the Shadowrun IP, so I would think they did not retain any FASA IP ownership.

There are quite a few Orion, Gorn, and Nausicaan ships in-game that could be made avaliable to the KDF, as well as the unused T2 ships that could be Retro/Fleet T5 ships, like the K'Tanco for one. More Fek'Ihri ships wouldn't be unreasonable either.

And it seems to be a license that has power from "beyond the grave".
Stephen V Cole, the guy who runs SFB, once gave a drastic example on the Star Fleet Battles forums:
If someone were to post for example an SSD of a converted FASA ship like the Loknar on his forums, he'd have no choice but to remove it or he could end up being sued for breaking copyright laws.
And he emphasized he had to pay lawyers to tell him that.
So while it's okay to do a conversion and post it up on your own site, it's not cool to do so on "his" forums since it's a commercial one.

Not quite.
FASA Corporation ceased active operations but still exists holding its IPs that it licenses, FASA Interactive was purchased by Microsoft.
The BattleTech and Shadowrun were sold to WizKids, when Microsoft acquired FASA Interactive they also acquired the electronic rights to Shadowrun in the process.
Currently Smith & Tinker have licensed the electronic gaming rights to MechWarrior, Shadowrun, and Crimson Skies from Microsoft.
You see there is a difference of IP were WizKids owns it and electronic gaming rights that Microsoft owns then (by extension when they brought FASA Interactive).

Someone always owns the IP because its a property, if the company goes under its hold by a creditor since its a assent, if the creator dies then its inherited by someone.
Only Pre-Disney did IPs could fall into public domain, well they still can do in some parts of the world.
In Star Trek FASA case I think since it been discontinued by the license holder, the rights to concepts go to the original designer.

Yeah the issue is I wouldn't mind if they cut and pasted the fleet vor'cha for a negh'var variant I just was more into the Negh'Var look than the vor'cha once they showed the Negh'Var in the series. Not to mention they need to fill the void of the design ships of the absorbed empires that now make up the KDF like the Orion, Nausicaans, Gorn, Lethean, Etc.

I forgot about the Orions, as pirates and mercs their ships would be composites of open market gear and captured components so I see something similar to a bugship in layout with a bridge full of universals.
