Hugh iirc didn't die, but he is no longer part of the collective.

Also note that you can't recreate characters that appeared in any of the Star Trek movies or TV series episodes due to legal matters.

You can drop references to him, but not place his likeness into the game directly.

well thats my interpretation of the Foundry TOS, though I have been told by one of my fleeties I have interpreted it wrong.

So I could create a new liberated Borg character and use him to refer to Hugh as to how he was freed? Or can I use the name Hugh without referring to past events as long as he doesn't look like anything in the tv show?

You could create a completely new, liberated Borg character, and he/she could say that he/she was part of Hugh's group of liberated Borg. That is fine.

But, creating a half Borg, half human character, and calling him Hugh, saying that he is THE Hugh, is a no-no.

I think creating hugh would be alright. Most borg look the same anyway, so creating a borg and calling him Hugh is probably not a big deal. The TOS says we can use characters, just not actor likenesses. Hugh was pretty generic looking.

You could also point out how much time has passed in-universe, and that any encounter with Hugh in STO's present would mean he's aged quite a bit and have that be why he looks different. After all, there are a number of such characters in game already, who have aged enough that there aren't likeness issues (Naomi Wildman and Icheb, for starters.)
