Well Im pretty sure false advertising doesnt have anything to do with Cryptic, its law. Or possibly D2D would give me a refund.

Regardless, I dont really care about the shield, thats not why I pre-ordered. I would just jump at a chance to get a refund as I dont find this game any where near as fun as I hoped it would be. Though that really is my fault.

Precisely. I think people are missing this aspect. Everyone here agreed to the TOS. It could say " You agree that the items advertised are not the items you are really going to get.." and if you agree, then cryptic isn't responsible for anything.
